Do you have an office in New York City?

What is an Article 78 proceeding, and when does a business need one?
Article 78 of the New York Civil Practice Law and Rules is the vehicle for asking a court to review a decision by a state or city agency, board, or official. Businesses use it to challenge license denials, permit decisions, contract determinations, and other agency actions; the questions a court may consider include "whether a determination was made in violation of lawful procedure, was affected by an error of law or was arbitrary and capricious or an abuse of discretion" (CPLR 7803(3)). The filing deadline is short: "[u]nless a shorter time is provided in the law authorizing the proceeding, a proceeding against a body or officer must be commenced within four months after the determination to be reviewed becomes final and binding upon the petitioner" (CPLR 217(1)), so call promptly if an agency has ruled against you.
I received a summons for an OATH hearing. Can you represent my business?
Yes. Bondar Legal represents businesses in proceedings before the NYC Office of Administrative Trials and Hearings and other agency hearings, and Eugene advises on when to contest a summons and when a negotiated resolution makes more sense.
Do you handle FOIL requests to city agencies?
Yes. The firm drafts requests, appeals denials and non-responses, and, when necessary, brings Article 78 proceedings to compel disclosure: under FOIL, a person "denied access to a record in an appeal determination ... may bring a proceeding for review of such denial pursuant to article seventy-eight of the civil practice law and rules" (Public Officers Law § 89(4)(b)).
